  Program Summary

  Mistakes happen and it is never fun to discover one in your court record. A document in the wrong file, non-party filing in your case, missing document - these errors in the court record can negatively impact your client creating barriers to certain remedies and could potentially impact your own license to practice. Fortunately, the Legislature recognized the inevitability of errors in a court record and enacted several statutes to allow a lawyer to put things right. Unfortunately, how those rules interface with judicial preference, local court rules, other statutes, and even the KRPCs can create a minefield for the unsuspecting. This CLE will: 1) demonstrate some of the errors in court records which commonly arise either from human error or by design of the efiling system and electronic filing rules; 2) examine the statutes and processes whereby a lawyer can petition the court to correct the record; and 3) examine pitfalls which may arise from affirmatively addressing errors in the record and discuss ways to moderate those risks.

  This move comes as a result of Creekside at Berryton closing. We would like to take this opportunity to acknowledge and thank Creekside at Berryton for being a wonderful host for our event over the past years.
